Mediation Process:

Mediation is a process where a neutral third party, the mediator, acts as an intermediary during a confidential settlement discussion and attempts to assist the parties in developing options for an amicable resolution of the dispute. Litigation is not the problem, unnecessary litigation is the problem. Mediation can often shorten the duration and intensity of litigated matters. Mediation offers an effective, confidential alternative or support role to litigation that is both time and cost efficient.

Mediation is a more practical approach than litigation because it allows the people who are actually involved in the dispute to maintain control over the outcome, avoiding the harsh realities of a court ordered judgment. This becomes a crucial element due to the long term effects of any settlement agreement. This element of successful mediation is what mitigates the resentment often found in traditional court rulings.
